NIVARO COMFORTLIFT™ CARRIER LIFETIME WARRANTY POLICY

1. WARRANTY COVERAGE
Nivaro Carriers LLC ("Company," "we," "us," or "our") warrants that the Nivaro ComfortLift™ Carrier ("Product") is free from defects in materials and workmanship under normal and intended use for the lifetime of the original purchaser ("Limited Lifetime Warranty"). This warranty is non-transferable and applies solely to the original purchaser of the Product.
2. WHAT THIS WARRANTY COVERS
Subject to the exclusions set forth in Section 3, this warranty covers the following defects arising under normal and intended use:
- Structural failure of the carrier frame, panels, or support system
- Buckle or fastener failure resulting from manufacturing defect
- Stitching separation or seam failure not caused by user damage
- Fabric or material defects present at the time of manufacture
- Hardware malfunction resulting from a defect in materials or workmanship
To be eligible for warranty coverage, the defect must arise during proper and intended use of the Product as described in the official product instructions provided by Nivaro.
3. WHAT THIS WARRANTY DOES NOT COVER
This warranty does not cover damage, failure, or deterioration resulting from any of the following:
- Misuse, abuse, neglect, or improper handling of the Product
- Use of the Product in a manner inconsistent with its intended purpose or official instructions
- Accidental damage, including drops, tears, cuts, punctures, or burns
- Unauthorized modifications, alterations, or repairs made to the Product
- Normal wear and tear, including fading, pilling, or minor surface abrasion resulting from regular use
- Damage caused by improper washing, drying, or care inconsistent with the care instructions provided
- Damage resulting from exposure to extreme temperatures, chemicals, or abrasive surfaces
- Cosmetic damage that does not affect the structural integrity or function of the Product
- Products purchased from unauthorized resellers or third-party marketplaces not expressly authorized by Nivaro
- Products with removed, altered, or illegible serial numbers or proof of purchase
- Damage caused by exceeding the stated weight capacity of the Product
- Damage resulting from failure to follow safety guidelines or age and weight recommendations specified by Nivaro
4. WARRANTY CLAIM PROCESS
To submit a warranty claim, the original purchaser must:
- Contact Nivaro customer support at the email or contact address listed on mynivaro.com with the subject line "Warranty Claim" - support@mynivaro.com
- Provide proof of original purchase including order number, purchase date, and purchaser name
- Provide a written description of the defect and the circumstances under which it occurred
- Provide photographic or video evidence of the defect
Nivaro reserves the right to request the return of the defective Product for inspection prior to approving any warranty claim. Return shipping costs for warranty inspection may be the responsibility of the claimant unless otherwise determined by Nivaro at its sole discretion.
5. WARRANTY REMEDIES
Upon verification of a valid warranty claim, Nivaro will, at its sole discretion, elect one of the following remedies:
- Replacement of the defective Product with the same or substantially similar product
- Issuance of store credit toward a future Nivaro purchase of equal or greater value
Nivaro does not guarantee the availability of the original Product model or colorway and reserves the right to substitute a comparable product of equal or greater value. Cash refunds are not provided under this warranty policy.
6. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIS WARRANTY IS THE SOLE AND EXCLUSIVE WARRANTY PROVIDED BY NIVARO WITH RESPECT TO THE PRODUCT. NIVARO EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL NIVARO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE USE OR INABILITY TO USE THE PRODUCT, EVEN IF NIVARO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
NIVARO'S TOTAL LIABILITY UNDER THIS WARRANTY SHALL NOT EXCEED THE ORIGINAL PURCHASE PRICE PAID BY THE ORIGINAL PURCHASER FOR THE PRODUCT.
7. GOVERNING LAW
This warranty policy shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under this warranty shall be resolved exclusively in the state or federal courts located within the State of Delaware, and the original purchaser consents to personal jurisdiction in such courts.
8. SEVERABILITY
If any provision of this warranty policy is found to be invalid, illegal, or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.
9. MODIFICATIONS TO THIS POLICY
Nivaro reserves the right to modify, amend, or discontinue this warranty policy at any time without prior notice. Any modifications will apply prospectively only and will not affect warranty claims submitted prior to the date of modification. The current version of this policy will always be available at mynivaro.com.

This Lifetime Warranty Policy constitutes the entire agreement between Nivaro and the original purchaser with respect to warranty coverage for the Nivaro ComfortLift™ Carrier and supersedes all prior or contemporaneous representations, warranties, or agreements relating to the same subject matter.
